Because all Triality services are provided "as-is," Triality's liability, if any, shall be limited to the total amount of payments received by Clients for the services giving rise to any dispute and or litigation.
Any intellectual property or otherwise technical information sent to Triality may be deemed by the United States Government to be exported beyond U.S. territory and received by foreign citizens. Client will take any and all necessary precautions to ensure Client is in compliance with U.S. state and federal export regulations. In no event shall Triality be held responsible or liable for said exportation.
Triality shall not be liable for any damages, including but not limited to, the following: computer related problems as a result of any viruses, worms, Trojan horses, etc. and any other items that may cause destruction to computer hardware, lost data, lost revenue, business interruption, and lost profits. Triality shall not be liable for any damages whatsoever for any delays or errors in providing services to Clients. Any and all claims in these respects are expressly waived by Client and any monetary damage shall be limited to the total amount of payment made to Triality for the services complained of.
